A four-day jury trial has been set for April 8, 2013, for former Wellington developer Fred Ziegler. The trial will be held in District County Court Judge Devin Odell’s courtroom in the Larimer County Justice Center in Fort Collins.
Ziegler was arrested in April 2012 on charges of felony theft stemming from his activities as a principal in ZWZ LLC in connection with the Wellington South-The Knolls development between 2004 and 2006. He pled not guilty to the five counts on Oct. 22.
The arrest warrant alleges that Ziegler and ZWZ co-mingled personal and business funds with money belonging to the Wellington South homeowners association. Prosecutors further allege that Ziegler and ZWZ used HOA money to pay for improvements on property owned by the developers and that Ziegler withdrew in excess of $54,600 from the HOA account that was never replaced.
Ziegler, 67, faces two Class 3 felony counts of theft in an amount of $15,000 or more and three Class 4 counts of theft of between $500 and $15,000.
